Requirements for Civil Drop-in Docket

 

·     The motion hearing MUST be for 15 minutes or less.  Motions for Summary Disposition must still be scheduled by submitting a praecipe, regardless of the length of the hearing.

 

·      Civil motion day is on Monday (Tuesday if Monday is a court holiday)

              Court holidays that occur on a Monday:

<   January 18, 2010 – Martin Luther King Day – motion day is Tuesday January 19, 2010

<   February 15, 2010 – Presidents’ Day – motion day is Tuesday February 16, 2010

<   May 31, 2010 – Memorial Day – motion day is Tuesday June 1, 2010

<   July 5, 2010 – Independence Day – motion day is Tuesday July 6, 2010

<   September 6, 2010 – Labor Day – motion day is Tuesday September 7, 2010

 

·      Civil motion hearing times:

<   Courtroom A - Honorable Gary C. Giguere.................Monday at 9:00 a.m.

<   Courtroom B - Honorable J. Richardson Johnson ..... Monday at 2:30 p.m.

<   Courtroom C - Honorable Pamela L. Lightvoet........... Monday at 9:00 a.m.

<   Courtroom D – Honorable Alexander C. Lipsey.......... Monday at 2:30 p.m.

 

·     The motion MUST be received by the Circuit Court Clerk’s Office, 227 West Michigan Avenue, Kalamazoo, MI 49007 at least seven (7) days prior to the hearing date.  MCR 2.119(C)(4).

 

The motion may be noticed for hearing without calling to schedule the event.  Choose an available date*, file the motion, the notice of hearing and proof of service with the Circuit Court Clerk’s Office at least seven (7) days prior to the scheduled event.

 

* It is the responsibility of the attorney/party to ensure the judge’s availability before scheduling a hearing date. The Judicial Non-Availability Schedule is noted above, or information can be obtained by calling (269) 383-8838 between the hours of 8:00 a.m. and 4:30 p.m.   The schedule will be updated as new information is received from the courts.  Check the posting often. 

 

·      Answers to motions MUST be received by the Circuit Court Clerk’s Office three (3) days prior to the scheduled event.  MCR 2.119(C)(4).

 

·      ONLY the party who filed the motion may cancel the hearing.  You may cancel your motion hearing by calling (269) 383-8838 between the hours of 8:00 a.m. and 4:30 p.m., or by calling the assigned judge’s staff. 

 

·     IF THESE RULES ARE NOT FOLLOWED, YOUR MOTION, AT THE DISCRETION OF THE ASSIGNED COURT, MAY NOT BE HEARD.
