REQUIREMENTS FOR FILLING OUT A PETITION FOR ADOPTION
- The petition for adoption must be typewritten or legibly printed in black ink.
- All names must be complete: first, middle and last name with no abbreviations.
- The name of the minor child/adult adoptee is listed on all documents exactly as it appears on the birth certificate. If the name is different than what is shown on the birth certificate, certified documentation to verify the change must also be filed.
- In a stepparent adoption the biological parent and the stepparent are the petitioners and both must sign the petition for adoption as the petitioning mother and the petitioning father. A consent is not required by the petitioning biological parent and their parental rights are not terminated, but they must join in the petition.
- The signature(s) of the petitioners must be complete with first, middle and last names.
- If both petitioners are employed, work telephone numbers, including any extension number, must be included. If the petitioners do not have a telephone, they must provide the court with a telephone number where they can be reached.
- A filing fee of $161.00 payable to Probate Court is required for each petition for adoption at the time the petition is filed.
- A certified copy of the adoptee's birth certificate must be filed with the petition for adoption.
- A copy of the petitioner's marriage license must be filed with the petition for adoption. (This requirement does not apply to single parent adoptions.)
- If it applies to your case, you are required to file a certified/attested copy of one or more of the following:
- Judgment of Divorce
- Order of Filiation
- Affidavit of Parentage
- Death Certificate (if birth parent is deceased)
ALL OF THE ABOVE REQUIREMENTS MUST BE MET WHEN COMPLETING YOUR
PETITION(S) FOR ADOPTION. IF NOT MET THE PETITION(S) WILL BE RETURNED TO YOU.
