WHEREAS, Act 288 of the Public Acts of Michigan of 1967 as amended provides for the promulgation of Rules by the Drain Commissioner to govern stormwater drainage facilities of new subdivisions, and

WHEREAS, Act 96 of the Public Acts of Michigan of 1987 provides for the promulgation of Rules by the Drain Commissioner to govern portions of stormwater facilities of mobile home parks, and

WHEREAS, Act 59 of the Public Acts of Michigan of 1978, as amended provides for the promulgation of Rules by the Drain Commissioner to govern stormwater facilities of condominium plans, and

WHEREAS, the Kalamazoo County Drain Commissioner conducted a review of previously adopted Rules (1998 as amended), and

WHEREAS, pursuant to this review, changes and modifications were proposed and reviewed by practicing consultants and communities within the county, and

WHEREAS, public comment was requested, received and carefully considered.

NOW, THEREFORE, IT IS HEREBY ORDERED, that the "Rules of the Kalamazoo County Drain Commissioner for Stormwater Management", dated February 10, 2003, shall be adopted and shall be followed in the processing of all developments that come under the jurisdiction of the Kalamazoo County Drain Commissioner, including plats, site condominiums, manufactured home communities, developments on lands discharging directly to County Drains, and other developments per local governments' ordinances.

IT IS FURTHER ORDERED, that The Rules be published in a booklet form and be made available to all interested parties for the cost of reproduction from the Office of the County Drain Commissioner.
