Private Property Disputes

Sometimes neighbors have problems with either new runoff either entering their property as a result of new construction or historic streamflow no longer flowing to them because of a neighbor's diversion from them. Unless the flow in question is that associated with an established county drain, the Drain Office has no legal jurisdiction. Instead, these private circumstances are considered as part of the common law. Here are three articles that describe these problems in more detail and outline some strategies to manage them. However, these problems are civil matters and these strategies are meant to help neighbors avoid costly and avoidable litigation.
